This policy explains your right to withdraw from a distance contract and how returns and refunds are handled. It forms part of our Terms & Conditions. It applies to Consumers and to Entrepreneurs with consumer rights (sole traders buying outside their professional scope). It does not create a statutory withdrawal right for other businesses (see Section 7).

1. 14‑day right of withdrawal
1.1. As a rule, you may withdraw from a distance contract within 14 days without giving any reason, subject to the exceptions in Section 2.
1.2. The withdrawal period expires 14 days after the day on which you (or a third party you indicate, other than the carrier) take physical possession of the goods. For an order of multiple items delivered separately, the period runs from receipt of the last item.
1.3. To meet the deadline, it is enough to send your withdrawal statement before the period expires.
2. Exceptions — made‑to‑order and configured Products
2.1. Under Art. 38 of the Polish Consumer Rights Act, the right of withdrawal does not apply, among others, to contracts:
- where the subject of performance is a non‑prefabricated item, manufactured to the Consumer's specification or serving to satisfy their individualised needs;
- where the subject is an item delivered in a sealed package which cannot be returned after opening for health‑protection or hygiene reasons, if the package was opened after delivery.
2.2. By default, all our Products carry the 14‑day right of withdrawal (every purchase is concluded as a distance contract). The only exception is a Product whose description on its product page expressly states that it is made to order (made‑to‑order) — built or configured to your specification. For such items the 14‑day withdrawal right does not apply, as permitted by Art. 38 above. Where this exception applies, we mark the made‑to‑order character clearly in the Product description before you place the Order.
3. How to withdraw
3.1. To withdraw, send us a clear statement of your decision before the deadline, by email to info@everestaudiolabs.com (or by post to the address above). You may use the model withdrawal form in the Appendix, but it is not mandatory.
3.2. Please include your order number, the date of the order/receipt, and your contact and (for the refund) payment details. We will acknowledge receipt of your withdrawal by email.
4. Returning the goods
4.1. Return the goods to us without undue delay and in any event within 14 days of notifying us of your withdrawal. The deadline is met if you send the goods before the 14‑day period expires.
4.2. You bear the direct cost of returning the goods. Given the value of the Products, we strongly recommend returning them in the original packaging, fully insured, via a tracked courier.
4.3. Diminished value. You are liable for any reduction in the value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning. We may deduct a corresponding amount from your refund.
5. Refunds
5.1. We will refund all payments received from you, including the standard delivery cost (except the additional cost where you chose a delivery method other than the cheapest standard one we offer), within 14 days of being informed of your withdrawal.
5.2. We may withhold the refund until we have received the goods back, or you have supplied proof of sending them, whichever is earlier.
5.3. We make the refund using the same payment method you used (PayPal / card via PayPal), unless you expressly agree otherwise; you incur no fees as a result of the refund.
6. Warranty / conformity claims (separate from withdrawal)
6.1. The right of withdrawal is separate from your statutory rights if the Product is faulty or not in conformity with the contract, and from any commercial warranty. Those are described in the Terms & Conditions (Sections 9–10). For a faulty Product you may have rights to repair, replacement, price reduction or withdrawal under the conformity rules — these apply regardless of the 14‑day distance‑withdrawal right and also to made‑to‑order Products.
6.2. To make a conformity/warranty claim, email info@everestaudiolabs.com with a description, proof of purchase and photos/details. We respond to Consumer complaints within 14 days.
7. Business customers (Entrepreneurs)
7.1. The statutory 14‑day withdrawal right does not apply to purchases made by an Entrepreneur in a professional capacity. Returns by such customers are accepted only if separately agreed in writing. Statutory liability for defects (rękojmia) is addressed in the Terms & Conditions.
